01 Who we are
T.Byrd's Heating & Cooling is a residential HVAC company operating in two North Carolina markets. The customer-facing brand is T.Byrd's Heating & Cooling. Services are delivered by the following legal entities:
- Charlotte market: TRU 72 T BYRD LLC, 317 Wilshire Ave SW Suite 10, Concord, NC 28025
- Raleigh & Triangle market: TRU72 NC LLC, 60 Mosswood Blvd 100, Youngsville, NC 27596

02 Information we collect
We collect information from three sources: information you provide directly, information collected automatically when you use the site, and information we receive from third parties.
Information you provide directly
- Contact and booking forms (name, phone number, email address, service address, equipment information, message)
- Cardinal Club checkout (name, billing address, payment method). Payment is processed by Workflo and tokenized by the payment processor; T.Byrd's does not store full card numbers.
- Financing applications (submitted by you directly to GreenSky; see Section 06)
- Chat widget conversations (transcripts retained by Workflo)
- Review submissions (name, rating, review text)
- SMS opt-in records (phone number, opt-in source, timestamp; see Section 04)
Information collected automatically
- IP address, browser type and version, device type, operating system
- Pages viewed, time on page, referring URL, navigation patterns
- Cookies and similar technologies (see Section 05)
- Approximate geographic location (city-level, derived from IP)
Information from third parties
- Google Business Profile (when you click "Call" or "Directions" from a GBP listing)
- Workflo (chat, booking, and form submissions route into T.Byrd's CRM)
- SMS gateway and aggregator providers (delivery confirmations, opt-out events)
03 How we use information
We use the information we collect for operational, service, and (where you have provided appropriate consent) marketing purposes.
Operational and service uses
- Respond to inquiries and questions submitted via the site, phone, email, or chat
- Schedule and dispatch service, including technician routing and arrival communication
- Send appointment reminders, scheduling confirmations, and service updates
- Provide customer support before, during, and after service
- Process Cardinal Club memberships, recurring billing, and renewal communication
- Refer to financing partners only with your consent and through your direct submission to the partner
- Send review requests after a completed service
- Communicate operational changes (technician running late, parts arrival, schedule shifts)
- Comply with legal obligations (warranty records, tax records, business-record retention)
- Detect, prevent, and respond to fraud and abuse
- Maintain and improve the site through aggregate analytics
Marketing communication
We send promotional or marketing communications (email or SMS) only when you have provided the appropriate consent for that channel. You may opt out of marketing communication at any time without affecting your ability to receive operational and transactional messages necessary to deliver service you have requested.
We do not sell personal information to third parties for their marketing purposes.
04 SMS and text messaging
If you opt in to receive SMS text messages from T.Byrd's, the following terms apply. This section is provided to comply with the Telephone Consumer Protection Act (TCPA), the CTIA Messaging Principles and Best Practices, and A2P 10DLC carrier requirements.
Opt-in consent
We send SMS messages only to phone numbers from which we have received explicit opt-in consent. Consent is captured at the point of opt-in (web form, written authorization, or verbal confirmation documented in our CRM) and a timestamped record of that consent is retained for compliance review. We do not text phone numbers that have not consented.
What you can expect
SMS messages from T.Byrd's may include:
- Appointment reminders and scheduling confirmations
- Technician dispatch updates (on the way, running late, arrival notifications)
- Service completion notifications and follow-up
- Cardinal Club renewal and billing communication
- Review requests after a completed service
- Promotional messaging (sent only when you have provided explicit promotional consent, which is captured separately from operational consent)
Message frequency, rates, and carrier disclaimer
Message frequency varies based on the nature of your service and the messages you have consented to receive. Standard message and data rates may apply per your carrier plan; T.Byrd's does not control or set those rates. Carriers are not liable for delayed or undelivered messages.
How to stop receiving SMS
- Reply STOP to any message to opt out. Your opt-out is processed immediately upon receipt of the STOP reply and we will not send further messages of that type.
- Reply HELP for assistance, or contact privacy@tbyrdhvac.com.
- You may re-opt-in at any time by submitting a new opt-in or contacting us directly.
Non-sharing of mobile information
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All text messaging originator opt-in data and consent records are excluded from any third-party sharing except vendors required to deliver the messaging service (such as SMS gateway providers, aggregators, and messaging platforms operating on T.Byrd's behalf).

06 Third parties and service providers
We share information with service providers to operate the business and deliver services to you. We do not sell personal information to data brokers, advertisers, or other third parties for their independent marketing use.
Service providers
- Workflo powers our website forms, chat widget, booking flow, Cardinal Club checkout, review widget, and operational email and SMS communications. Workflo's privacy policy governs data we send to or receive from the platform.
- SMS gateway and aggregator providers process the delivery of text messages on our behalf. They receive the recipient phone number, message contents necessary to deliver the message, and delivery status.
- Payment processor (engaged through Workflo) processes Cardinal Club payments. Card information is tokenized at the processor; T.Byrd's stores only the token reference, not the underlying card number.
- Google provides Google Analytics 4, Google Tag Manager, Google Business Profile interactions, Google Ads (when applicable), and reCAPTCHA on forms.
- Cloudflare provides DNS, CDN, and DDoS protection. Cloudflare sees IP and request metadata; it does not see form contents.
- LiteSpeed handles server-side caching only and does not access personal information.
- GreenSky is our financing partner. When you apply for financing, you submit your application directly to GreenSky. T.Byrd's may receive an approval or decline status, not the underlying application data.
Legally required sharing
We may share information in response to a subpoena, court order, regulatory request, or to prevent or investigate fraud, threats to safety, or violations of our terms.
07 Your choices and rights
North Carolina does not have a comprehensive consumer-privacy statute as of the effective date of this policy. We voluntarily honor the following rights for customers in any state:
- Access: request a copy of the personal information we hold about you
- Correction: request that we update inaccurate or incomplete data
- Deletion: request that we delete your personal information, subject to legal, tax, and warranty retention requirements
- Opt-out of marketing email: use the unsubscribe link in any marketing email
- Opt-out of marketing SMS: reply STOP to any message (see Section 04)
- Opt-out of cookies: use your browser controls; respond to the consent banner if deployed
- Data portability: request your data in a machine-readable format
- Do-not-sell confirmation: we do not sell personal information; you may request written confirmation

08 Data retention
- Service and warranty records: retained for 7 years or as required by the warranty or applicable law, whichever is longer
- Cardinal Club records: duration of membership plus 7 years
- SMS opt-in and consent records: retained for the duration of the consent and for a reasonable period after opt-out, as required to demonstrate compliance with TCPA and carrier review
- Marketing contact data: retained until you opt out, then held on a 30-day suppression list to honor the opt-out
- Web analytics: aggregate data retained indefinitely; individual user data retained per the Google Analytics 4 default (14 months) unless adjusted
- Cookies: per the cookie's stated lifetime (session to 2 years)
09 Children's privacy
This site is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If a parent or guardian believes a child under 13 has provided information, contact privacy@tbyrdhvac.com and we will promptly delete it.
10 Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including:
- HTTPS encryption site-wide
- Access controls and authentication on internal systems
- Vendor due-diligence on the service providers we rely on
However, no method of transmission over the internet, and no method of electronic storage, is fully secure. While we use commercially reasonable safeguards, we cannot guarantee absolute security of information transmitted to or stored by us. If we become aware of a security incident affecting personal information, we will follow applicable North Carolina breach-notification law.
11 Third-party links and embedded services
The site contains links to and embeds from third parties. Each is governed by its own privacy policy:
- Workflo widgets and embeds (booking, chat, checkout, reviews)
- The GreenSky financing application
- Google Maps embeds on the contact pages
- Manufacturer warranty portals, blog references, and other outbound links
12 Changes to this policy
We may update this Privacy Policy from time to time. Material changes will be announced via a banner on the site for at least 30 days, and the Effective date at the top of the page will be updated. Continued use of the site after the effective date of an update constitutes acceptance of the updated policy.
